The Court of Appeal has rejected an application by Nana Appiah Mensah (NAM1), CEO of the defunct Menzgold Ghana Limited, to halt his ongoing criminal trial.

NAM1 had sought to suspend the High Court proceedings while appealing a ruling that mandated him to present his defense.

His appeal argued that the High Court’s order was premature. However, state prosecutors argued that the application was an abuse of court process and lacked sufficient justification.

On May 19, 2025, a three-judge panel of the Appeal Court, comprising Justice Gbiel Suurbaareh (presiding), Justice Afia Serwaa Asare-Botwe, and Justice Christopher Archer, unanimously dismissed NAM1’s application. This decision allows the High Court trial to proceed.

NAM1 faces several charges, including:

  • Selling gold without proper licensing
  • Defrauding investors
  • Money laundering
  • Breach of trust

Frederick Forson, representing affected Menzgold customers, expressed satisfaction with the ruling, viewing it as a step forward in the pursuit of justice.

NAM1 has indicated he may appeal the decision at the Supreme Court, pending legal advice.
